It’s November 2018, and this is a CRITICAL advisory to California used car dealers! The absolute importance of after sales service for licensed DMV auto dealers in 2018 could not be a bigger concern in keeping great relationships and expanding your dealer business through word-of-mouth! Especially in the age of social media and virality lurking behind every corner if you decide to cheat a customer!
I would bet that the majority of your car sales are being made on an, as-is basis. This means that you are not contractually required to provide any type of service to any vehicle you sell.
I’m also willing to bet that you have heard that “the customer is always right”. Furthermore, you have heard that you should always do everything you can to make sure that you have a happy customer.
No arguments there! So when does “going the extra mile” put your used car dealership in a position to be sued by your own clients?
Imagine that you sell a car as-is and two weeks later, some small challenge is happening. Perhaps the air conditioning is not really getting as cold as your customer expected or their windshield wipers seem to be a little out of alignment.
Regardless what the issue is, you know you can get in there and fix for them without too much trouble. Now the questions is should you?
Keep in mind your As-Is Sales Contract and the Federal Buyer’s Guide didn’t list any warranties!!
You’ve got to be careful with this. After 20 years in the insurance business, I can tell you right now there’s a ton of great used car dealers that got caught in this exact trap.
You have already sold the car (or truck) as-is and your sales contract states it. Even though you might want to fix that minor detail, by doing so you set a precedence with your client that you are willing to operate outside the constraints of your legally-binding sales contract.
Further, that customer could potentially come back to you later and ask you to provide even more after-sale service and would be justified to do so. And if for some reason you decide not to provide the additional service as they now feel entitled to demand from you, then off to small-claims court you go!
